         FMCSA Issues Regional Emergency Declaration Due to Severe Winter Weather

         On January 23, 2026, the Federal Motor Carrier Safety Administration (FMCSA) issued a Regional Emergency Declaration in response to severe winter storms and dangerously cold temperatures affecting much of the United States. The declaration covers over 40 states and jurisdictions and is intended to support the immediate transportation of essential supplies and restoration of critical services needed to protect public health and safety.
         &#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          Under this declaration, temporary relief from federal Hours-of-Service (HOS) limits is granted to commercial motor vehicle drivers and carriers only when they are providing direct assistance for emergency relief efforts. This includes transporting essential goods or services directly related to addressing the emergency. Routine commercial deliveries, mixed loads, and long-term recovery or reconstruction activities are not eligible for this relief.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          All other federal safety regulations remain fully in effect, including CDL requirements, drug and alcohol testing, insurance coverage, hazardous materials rules, and vehicle size and weight limits. Drivers and carriers under an out-of-service order are not eligible for the exemption. Once emergency operations end, drivers must return to normal HOS compliance, following required rest periods before resuming regular commercial activity.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          The Emergency Declaration is effective immediately and will remain in place until the emergency conditions end or until 11:59 PM (ET) on February 6, 2026, whichever occurs first. FMCSA will continue monitoring conditions and may modify, extend, or terminate the declaration as necessary.

          Major Change in Driver Compliance Standards
         &#xD;

          Effective June 25, 2025, the Commercial Vehicle Safety Alliance (CVSA) will enforce a new out-of-service (OOS) criteria that  significantly impact commercial drivers and motor carriers. This change comes in response to an executive order by President Donald J. Trump, titled "Enforcing Commonsense Rules of the Road for America’s Truck Drivers."          &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          The CVSA Board of Directors voted to include non-compliance with 49 CFR 391.11(b)(2) — English language proficiency — as a violation warranting placing a driver out of service in the United States.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;b&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/b&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;b&gt;&#xD;
      
           What the Regulation Says
          &#xD;
    &lt;/b&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          Under 49 CFR 391.11(b)(2), commercial motor vehicle (CMV) drivers must be able to:
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          Read and speak the English language sufficiently to:
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          ✅ Converse with the general public,
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          ✅ Understand highway traffic signs and signals,
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          ✅ Respond to official inquiries,
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          ✅ Make entries on reports and records.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          Until now, violations of this provision were considered compliance issues but did not lead to a driver being placed out of service during roadside inspections.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;b&gt;&#xD;
      
           What’s Changing
          &#xD;
    &lt;/b&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          The CVSA will now add “English Proficiency (U.S. Only)” to Part I – Driver of the North American Standard Out-of-Service Criteria. 
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          This means, a driver who cannot sufficiently read or speak English to communicate with safety officials during an inspection may now be placed out of service on the spot.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          Inspectors will follow new FMCSA-issued guidance to apply this rule consistently across all states.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          This change applies only within the U.S., not Canada or Mexico.

    &lt;br/&gt;&#xD;

           Key Provisions of the Executive Order
          &#xD;

          The order instructs the Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) to enforce the existing federal regulation (49 C.F.R. § 391.11(b)(2)) that requires commercial drivers to read and speak English sufficiently to converse with the general public, understand traffic signs and signals, respond to official inquiries, and make entries on reports and records.
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          It rescinds the 2016 guidance that limited enforcement of English proficiency requirements, directing the FMCSA to issue new inspection procedures.
         &#xD;

          The order mandates that drivers who fail to meet English proficiency standards be placed out-of-service, effectively barring them from operating commercial vehicles until compliance is achieved.

          The DOT is tasked with reviewing the issuance of non-domiciled Commercial Driver’s Licenses (CDLs) by state agencies to identify irregularities and ensure the authenticity and validity of both domestic and international commercial driving credentials.

          Within 60 days, the Secretary of Transportation must identify and implement additional actions to improve the working conditions of American truck drivers.

         Beginning November 18, 2024, all State Driver Licensing Agencies will be required to suspend or downgrade the commercial driving privileges of any driver with a "prohibited" status in the FMCSA's Drug and Alcohol Clearinghouse. This change is part of the FMCSA's ongoing effort to improve road safety and ensure that only qualified drivers are eligible to operate commercial motor vehicles (CMVs).
         &#xD;
  &lt;br/&gt;&#xD;
  &lt;br/&gt;&#xD;
  &lt;b&gt;&#xD;
    
          What Does This Mean for CDL Drivers?
         &#xD;
  &lt;/b&gt;&#xD;

          If a driver has status as "prohibited" in the Clearinghouse, their CDL will be downgraded, meaning they will lose their commercial driving privileges.              Decals must be placed on both sides of the cab.

          The International Registration Plan (IRP) is a registration reciprocity agreement among the contiguous U.S. states, the District of Columbia, and Canadian provinces. The agreement allows commercial motor carriers to register their vehicles in their home state and obtain one license plate and one cab card (registration) that are valid across all IRP jurisdictions. This simplifies the process of operating interstate and internationally, as carriers no longer need to register their vehicles separately in each state or province they operate in.

           The rule amends the U.S. Department of Transportation's regulated industry drug testing program to include oral fluid testing.             The Safety Measurement System (SMS) uses this safety data to assess carriers in the seven Behavior Analysis and Safety Improvement Categories (BASICs). The BASICs are: Unsafe Driving, Crash Indicator, Hours-of-Service (HOS) Compliance, Vehicle Maintenance, Controlled Substances/Alcohol, Hazardous Materials (HM) Compliance, and Driver Fitness.

         Pre-employment Investigations for Drug and Alcohol Program Violations

         Beginning January 6, 2023, a pre-employment Clearinghouse query will satisfy the requirement to investigate a prospective driver's previous drug and alcohol program violations, as set forth in 49 CFR 391.23(e)(4) and 382.413(b).
         &#xD;
  &lt;div&gt;&#xD;
    
          Employers of CDL drivers are required to conduct background investigations before hiring a driver. This process includes determining if the driver has violated the drug and alcohol regulations of any DOT mode within the past three years (49 CFR 391.23(e)(1)-(3) and 382.413(a)). 
         &#xD;
  &lt;/div&gt;&#xD;
  &lt;div&gt;&#xD;
    
          Beginning January 6, 2023, prospective employers must conduct a pre-employment query of the Clearinghouse, as set forth in § 382.701(a), to comply with the inquiry requirement in §§ 382.413(b) and 391.23(e)(4), as it pertains to FMCSA-regulated employers. Inquiries not conducted under § 382.701(a) will not satisfy these inquiry requirements.
         &#xD;

          However, carriers will still need to contact a driver's former employers to verify that the driver worked there, the period of work and to obtain information about any accidents the driver may have had.

      <title>Connecticut Highway Use Fee Permit effective January 1, 2023</title>

&lt;/h3&gt;&#xD;

          January 1, 2023 Highway Use Fee will be imposed on certain carriers for the privilege of operating or causing to be operated on any highway (i.e., public road) in Connecticut.
          &#xD;
    &lt;br/&gt;&#xD;
    &lt;br/&gt;&#xD;
    
          The Highway Use Fee is applicable to calendar months beginning on or after January 1, 2023. The first Highway Use Fee Return is due on or before February 28, 2023.
          &#xD;
    &lt;br/&gt;&#xD;
    &lt;br/&gt;&#xD;
    
          Certain carriers will be required to register for the Highway Use Fee by January 1, 2023. After registering, a Highway Use Fee Permit will be issued.
          &#xD;
    &lt;br/&gt;&#xD;
    &lt;br/&gt;&#xD;
    
          When to File the Highway Use Fee
          &#xD;
    &lt;br/&gt;&#xD;
    &lt;br/&gt;&#xD;
    
          Monthly filings. The Highway Use Fee Returns are due on or before the last day of the month following the end of the monthly filing period. The first Highway Use Fee Return is due on or before February 28, 2023.
          &#xD;
    &lt;br/&gt;&#xD;
    &lt;br/&gt;&#xD;
    
          ❗️you must place a copy of your permit in each vehicle that you operate or cause to be operated in the State of Connecticut on or after the effective date
         &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
