Terms of Service

Last Updated: November 4, 2026

Welcome to ProSafety. These Terms of Service govern your use of our website, www.prosafetyoffice.com, and the services provided by ProSafety, operated by Prosafety LLC, an Illinois-based business.

By accessing our website, requesting services, scheduling consultations, or engaging ProSafety, you agree to these Terms of Service, as applicable.

1. Our Services

ProSafety provides professional services to trucking companies, owner-operators, freight brokers, and other transportation industry businesses.

Our services may include DOT and FMCSA compliance assistance, safety management, driver qualification support, regulatory registrations, risk management assessments, safety audits and audit preparation, training, business consulting, claims assistance, and related administrative services.

The specific scope of services, fees, responsibilities, and deliverables may be established through individual service agreements, proposals, subscriptions, or written confirmations.

2. Service Agreements

Certain services require a separate agreement between ProSafety and the client.

These agreements may establish service scope, pricing, payment terms, duration, cancellation requirements, and other applicable conditions.

If any provision of these Terms conflicts with a signed service agreement, the signed agreement will control with respect to the services covered by that agreement.

3. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information necessary for ProSafety to perform requested services.

Motor carriers and other regulated businesses remain responsible for complying with applicable federal, state, and local laws and regulations.

Engaging ProSafety does not transfer a client's statutory or regulatory responsibilities to ProSafety.

Clients are responsible for reviewing information submitted on their behalf and promptly notifying us of any errors, changes, or missing documentation.

4. Consulting and Professional Guidance

ProSafety provides consulting and advisory services based on applicable regulations, industry practices, professional experience, and information available at the time services are performed.

Our recommendations are intended to assist clients in understanding compliance obligations, identifying risks, and improving business practices.

Consulting services do not constitute legal representation, and ProSafety does not guarantee specific regulatory, financial, operational, or insurance outcomes.

5. Regulatory Filings and Third-Party Services

Certain services may involve filings, applications, or communications with government agencies, regulatory authorities, insurance companies, or other third parties.

ProSafety is not responsible for processing delays, system outages, agency decisions, or other circumstances beyond our reasonable control.

Government filing fees and third-party charges may apply in addition to ProSafety's service fees, as disclosed during the service process.

Approval, acceptance, or processing of any application remains subject to the requirements and decisions of the responsible authority.

6. Safety Assessments and Reports

Safety performance reviews, risk management assessments, compliance evaluations, and other reports are prepared using available information and the scope of services agreed upon.

These reports are intended to identify potential risks, provide recommendations, and support informed business decisions.

Unless expressly stated otherwise, our assessments are independent consulting evaluations and do not constitute official FMCSA audits, government safety ratings, or insurance underwriting determinations.

ProSafety does not guarantee reductions in violations, CSA scores, insurance premiums, or other measurable outcomes.

7. Claims Assistance

ProSafety may provide administrative assistance with insurance claims, including claim reporting, document coordination, communication support, and claim status monitoring.

Insurance coverage determinations, claim approvals, settlements, and payments remain subject to the applicable insurance policy and the decisions of the insurer or authorized claims administrator.

ProSafety does not guarantee claim approval, payment, or settlement outcomes. Claims assistance does not include acting as a public adjuster or providing legal representation unless separately authorized and appropriately licensed.

8. Payments and Cancellations

Fees for services are established through published pricing, invoices, booking confirmations, proposals, or individual service agreements.

Payment may be required before services begin.

Paid consultations, recurring services, project-based assignments, and other engagements may have different cancellation, rescheduling, and refund conditions.

Applicable terms will be communicated during booking or established in the relevant service agreement.

Unless otherwise required by law or expressly agreed in writing, refunds are not guaranteed for services already performed.

9. Confidentiality and Information Protection

ProSafety recognizes the confidential nature of client business information, driver records, compliance documents, and other information received in connection with our services.

We take reasonable measures to protect confidential information and use it for authorized business purposes.

Clients must provide any necessary permissions or authorizations before requesting services involving third-party personal information or protected records.

Our collection and handling of personal information are further described in our Privacy Policy.

10. Website Content and Intellectual Property

The content of this website, including text, graphics, reports, training materials, documents, and other original materials, belongs to ProSafety or its respective rights holders unless otherwise indicated.

11. Limitation of Liability

To the extent permitted by applicable law, ProSafety is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website or services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Any additional limitations of liability applicable to paid services may be established in the relevant service agreement.

12. Third-Party Websites and Platforms

Our website may contain links to external websites, regulatory resources, payment processors, scheduling platforms, and educational services.

These third-party services operate under their own terms and policies.

ProSafety is not responsible for the content, availability, or independent practices of third-party websites and platforms.

13. Changes to These Terms

ProSafety may update these Terms of Service periodically to reflect changes in business operations, services, or applicable legal requirements.

Updated terms will be published on this page with a revised effective date.

Material changes affecting existing paid engagements will be handled in accordance with applicable agreements and law.

14. Governing Law
